Terms of Service
These Terms govern your use of Datacat, including character uploads, imports, browsing, downloads, discussion, and related tools.
1. Acceptance of These Terms
These Terms of Service (the "Terms") are a binding agreement between you and Datacat ("Datacat", "we", "us", or "our"). By accessing or using the website, uploader, character library, extraction/import tools, private vault features, discussion features, or any related services (collectively, the "Site"), you agree to these Terms.
If you do not agree to these Terms, you must not access or use the Site. We may update these Terms from time to time. Your continued use of the Site after an update means you accept the updated Terms.
2. Adults Only
The Site is intended only for adults. You must be at least 18 years old and the age of legal majority in your jurisdiction to access, register for, upload to, or otherwise use the Site.
You may not use the Site if you are a minor, if you are legally prohibited from using the Site, or if your use would violate any applicable law. We may suspend or terminate access if we believe a user is underage or has misrepresented their age.
3. Nature of the Site
Datacat provides tools for uploading, importing, organizing, browsing, discussing, and downloading AI character cards, bot definitions, related metadata, and supporting media. The Site may include user-generated fictional content and automated extraction or conversion tools.
The Site is not a medical, mental health, legal, financial, or emergency service. Do not rely on the Site or user-generated character content for professional advice, crisis support, or emergency response.
4. Accounts and Security
You are responsible for all activity under your account, session, device token, uploads, and profile. Keep your login credentials and sessions secure. Notify us if you believe your account has been compromised.
You must provide accurate account information, must not impersonate another person, and must not use the Site to mislead others about your identity, rights, or affiliation with any creator, platform, or organization.
5. User Content
5.1 Your Content
"User Content" means any text, character card, prompt, persona, scenario, image, avatar, metadata, tag, comment, report, file, link, or other material that you submit, upload, post, import, transmit, or make available through the Site. You retain ownership of your User Content, subject to the licenses and permissions granted in these Terms.
5.2 License to Datacat
By submitting User Content, you grant Datacat a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, cache, resize, convert, modify, adapt, publish, display, distribute, transmit, moderate, analyze, and otherwise use that User Content in connection with operating, securing, providing, improving, and promoting the Site.
This license allows us to provide features such as previews, downloads, search, moderation, backups, format conversion, media delivery, and shared pages. This license continues after you stop using the Site only to the extent reasonably necessary to operate the Site, preserve shared or incorporated content, comply with law, maintain backups, enforce these Terms, or protect users and the public.
5.3 Content Responsibility
You are solely responsible for your User Content and for the consequences of submitting or publishing it. You represent and warrant that you own, created, or otherwise have all rights and permissions needed to submit your User Content and grant the license above, and that your User Content does not violate any law, third-party right, or these Terms.
5.4 Character and AI Content
Datacat allows a broad range of fictional, AI-generated, roleplay, and character-based content, including adult, mature, dark, horror, and controversial fictional themes.
We aim to be permissive toward fictional adult creative expression. Mature or uncomfortable fictional themes are not automatically prohibited just because they are controversial, disturbing, or morally sensitive.
However, fictional framing has limits. Labeling content as fictional, fantasy, parody, AI-generated, roleplay, or "not real" does not permit content involving sexualized minors, CSAM or CSAM-style material, grooming, exploitation, real-person targeting, illegal activity, credible threats, self-harm instructions, doxxing, malware, or platform abuse.
Fictional adult content may be allowed where it stays within legal and safety boundaries, does not involve minors or characters reasonably perceived as minors, is not directed at real people without consent, and does not facilitate real-world harm.
5.5 Avatar and Preview Guidelines
Avatar images, preview images, thumbnails, banners, profile images, and other public-facing media must be appropriate for public display.
Explicit nudity, pornographic imagery, overtly sexual imagery, sexualized minors, age-ambiguous sexualized characters, gore, or shocking imagery is not permitted in avatars, previews, thumbnails, or banners, even where the underlying fictional content may otherwise be allowed behind appropriate access controls.
6. Prohibited Content and Conduct
Datacat allows adult fictional creative content, including mature themes, dark fantasy, horror, taboo subject matter, and morally complex themes. We do not prohibit fictional adult content merely because it explores uncomfortable or controversial ideas.
The hard lines below concern minors, sexual exploitation, real-person abuse, illegal activity, credible harm, privacy violations, and platform integrity. You agree not to submit, upload, post, import, transmit, request, generate, facilitate, or distribute content or conduct that:
- Depicts, promotes, eroticizes, solicits, normalizes, or facilitates sexual abuse or sexualization of minors in any form, including real, fictional, drawn, AI-generated, stylized, age-ambiguous, or roleplay depictions.
- Contains, requests, generates, links to, or facilitates child sexual abuse material, child sexual exploitation material, grooming, sexual solicitation of minors, or sexual content involving any person or character represented, described, or reasonably perceived as under 18.
- Uses images, likenesses, descriptions, or depictions of minors, or people who appear to be minors, in an adult, sexual, exploitative, fetish, romanticized, or roleplay context.
- Promotes or facilitates human trafficking, sexual exploitation, coercion, blackmail, extortion, or abuse.
- Targets, sexualizes, impersonates, exploits, harasses, or threatens a real person without consent.
- Contains or facilitates non-consensual intimate imagery, sexual deepfakes of real people, doxxing, stalking, harassment, or abuse.
- Presents real-world sexual violence, torture, graphic injury, death, or abuse as real, instructional, exploitative, celebratory, or directed at real people.
- Is illegal, encourages illegal activity, or provides instructions, services, or tools for committing crimes, evading law enforcement, bypassing safety systems, or harming others.
- Promotes terrorism, violent extremism, credible threats, political violence, or targeted physical harm.
- Encourages, instructs, glorifies, or facilitates self-harm, suicide, eating disorders, or other serious physical harm.
- Contains hate speech, dehumanization, or incitement to violence or discrimination against protected groups.
- Discloses personal, private, sensitive, intimate, or identifying information about another person without consent.
- Infringes or misappropriates copyright, trademark, publicity, privacy, trade secret, or other legal rights.
- Contains malware, phishing, spam, deceptive links, scams, credential theft, or attempts to manipulate Site ranking, reporting, moderation, or account systems.
- Attempts to bypass age gates, access controls, moderation controls, rate limits, security features, or any technical restriction of the Site.
6.1 Prohibited Platform Use
You further agree not to attempt to gain unauthorized access to any account, system, database, or network; interfere with Site operation; harvest user data without consent; sell access to the Site; or use the Site for commercial purposes without our prior written permission.
7. Safety, Self-Harm, and Emergencies
The Site may contain fictional or user-generated content, but it must not be used to encourage real-world self-harm, suicide, abuse, violence, or illegal conduct. Content that provides instructions for self-harm or tries to persuade a person to harm themselves or others is prohibited.
If you or someone else may be in immediate danger, contact local emergency services or a qualified crisis support service. Datacat cannot provide emergency support.
8. Moderation and Enforcement
We may review, remove, quarantine, restrict, or block User Content or accounts at any time if we believe they violate these Terms, create legal risk, harm users, or threaten the operation of the Site. We may preserve records where reasonably necessary for safety, security, legal compliance, or abuse investigation.
We may report apparent child sexual abuse material, exploitation, credible threats, imminent harm, or other serious illegal activity to appropriate reporting bodies, service providers, or law enforcement when we believe it is necessary or legally required.
9. Intellectual Property
9.1 Datacat Property
The Site, including its software, interface, design, databases, compilation, original text, graphics, features, and functionality, is owned by Datacat or its licensors and is protected by copyright, trademark, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer the Site except as allowed by law or by written permission.
9.2 Third-Party and Source Platform Rights
You are responsible for respecting the rights and rules of third-party creators, source platforms, model providers, and media owners. Datacat is not affiliated with JanitorAI, Chub, Character.AI, OpenRouter, Google, Cloudflare, or any other third-party service unless expressly stated.
9.3 Copyright Complaints
We respect intellectual property rights and respond to valid notices of alleged infringement. If you believe your copyrighted work has been infringed on the Site, contact legal@datacat.run or use the Contact page and include: your physical or electronic signature; identification of the copyrighted work; identification and location of the allegedly infringing material; your contact information; a statement that you have a good-faith belief the use is unauthorized; and a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act for the owner.
10. Third-Party Services
The Site may interact with third-party services, source websites, content delivery networks, authentication providers, storage providers, AI providers, and moderation or security services. Your use of third-party services may be governed by their own terms and policies. We are not responsible for third-party content, services, outages, policy changes, or decisions.
11. Availability and Changes
We may change, suspend, limit, or discontinue any part of the Site at any time. We do not guarantee that any content, upload, account, feature, import, download, or external source will remain available, compatible, complete, or error-free.
12. Disclaimers
The Site is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, safety, and uninterrupted operation.
User Content is created or submitted by users and third parties. We do not endorse, verify, or assume responsibility for User Content.
13. Limitation of Liability
To the fullest extent permitted by law, Datacat and its operators, contributors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, content, goodwill, or access, arising from or related to your use of the Site.
14. Indemnity
You agree to defend, indemnify, and hold harmless Datacat and its operators, contributors, service providers, and affiliates from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your User Content, your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
15. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you violated these Terms, created risk for the Site or users, or used the Site unlawfully. You may stop using the Site at any time.
